തിരുവനന്തപുരം : വയനാട് ലോക്സഭാ മണ്ഡലത്തിലെയും പാലക്കാട്, ചേലക്കര നിയമസഭാ മണ്ഡലങ്ങളിലെയും ഉപതിരഞ്ഞെടുപ്പ് പെരുമാറ്റച്ചട്ടം ലംഘിച്ച് പഞ്ചായത്ത് സെക്രട്ടറിമാരെ സ്ഥലം മാറ്റിയതിനെതിരെ കേന്ദ്ര തിരഞ്ഞെടുപ്പ് കമ്മിഷനും മുഖ്യ തിരഞ്ഞെടുപ്പ് ഓഫീസര്‍ക്കും പ്രതിപക്ഷ നേതാവ് പരാതി നല്‍കി.
വയനാട് ജില്ലയിലെ മീനങ്ങാടി, കണിയാമ്പറ്റ ഗ്രാമപഞ്ചായത്തുകള്‍, പാലക്കാട് ജില്ലയിലെ മങ്കര, തിരുവേഗപ്പുറം, പരുതൂര്‍ എന്നീ ഗ്രാമപഞ്ചായത്തുകളിലെ സെക്രട്ടറിമാരെയാണ് തിരഞ്ഞെടുപ്പ് പെരുമാറ്റച്ചട്ടം ലംഘിച്ച് സ്ഥലം മാറ്റിയത്. സ്ഥലം മാറ്റ ഉത്തരവില്‍ 14-10-2024 എന്ന് കാണിച്ചിട്ടുണ്ടെങ്കിലും, ഉത്തരവില്‍ ഒപ്പിട്ടത് 18-10-2024-നാണെന്ന് വ്യക്തമാണ്. പെരുമാറ്റച്ചട്ടം മറികടക്കുന്നതിനു വേണ്ടി ചട്ടം നിലവില്‍ വരുന്നതിന് മുന്‍പുള്ള തീയതി എഴുതിച്ചേര്‍ത്തതാണെന്നും നടപടി വേണമെന്നും പ്രതിപക്ഷ നേതാവ് പരാതിയില്‍ ചൂണ്ടിക്കാട്ടി.

I write to elicit your urgent attention towards a blatant breach of the model code of conduct in Kerala by the LSGD department of the State Government.
With the Election Commission of India declaring byelections in the Wayanad Lok Sabha constituency and the Palakkad and Chelakkara Assembly constituencies, the election code of conduct has come into effect effective October 15, 2024. However, the LSGD department, vide order LSGD/PD/21951/2024-DEA3, has effected the transfer of secretaries in pachayaths in the poll-bound Wayanad and Palakkad districts. The secretaries in Meenangadi, Kaniyambetta Grama Panchayats in Wayanad district, Mankara, Thiruvegappura, and Paruthur Grama Panchayats in Palakkad district, among others, have been transferred as per the above stated order. Though the date on the order has been shown as 14-10-2024, it is evident that the order has been signed on 18-10-2024. This clearly indicates that a date prior to the model code of conduct date was shown on the order to circumvent the model code of conduct. The impugned order is attached for your kind perusal.
Kindly note that 4 different orders of the Kerala Administrative Tribunal (KAT) have been cited as the reason for the impugned government order. However, none of the petitioners mentioned in the KAT orders have figured in the order.
Furthermore, the order has been cited as the modification/erratum to the general transfer order issued in September 2024. But the secretaries who have not applied for general transfer or have not even completed one year have been transferred through the order. This clearly implies that the impugned government order is a colorable step to circumvent the model code of conduct.
Taking into consideration the above mentioned facts, I request your good self to take the necessary actions on this violation.
