മുന്‍ ഹൈക്കോടതി ചീഫ് ജസ്റ്റിസ് എസ്. മണികുമാറിനെ മനുഷ്യാവകാശ കമ്മിഷന്‍ ചെയര്‍മാനായി നിയമിക്കണമെന്ന സര്‍ക്കാരിന്റെ ശിപാര്‍ശ അംഗീകരിക്കരുതെന്ന് ആവശ്യപ്പെട്ട് പ്രതിപക്ഷ നേതാവ് വി.ഡി സതീശന്‍ ഗവര്‍ണര്‍ക്ക് കത്ത് നല്‍കി.
പക്ഷപാതരഹിതമായി പ്രവർത്തിക്കാൻ എസ്. മണികമാറിന് കഴിയുമോയെന്ന ആശങ്കയും കത്തിൽ ചൂണ്ടികാട്ടുന്നു.
മനുഷ്യാവകാശ കമ്മിഷന്‍ ചെയര്‍മാനെ തെരഞ്ഞെടുക്കുന്ന സമതിയിലും എസ്. മണികുമാറിനെ നിയമിക്കുന്നതിനെതിരായ വിയോജനക്കുറിപ്പ് രേഖപ്പെടുത്തിയിട്ടുണ്ടെന്നും പ്രതിപക്ഷ നേതാവ് കത്തില്‍ പറയുന്നു.
മാനദണ്ഡങ്ങള്‍ക്ക് വിരുദ്ധമായി മണികുമാറിന്റെ പേര് മാത്രമാണ് സമിതി യോഗത്തില്‍ സര്‍ക്കാര്‍ നിര്‍ദേശിച്ചത്. ഏകപക്ഷീയമായി ഒരു പേര് അടിച്ചേല്‍പ്പിക്കാനുള്ള തീരുമാനം ജനാധിപത്യവിരുദ്ധവും ദുരൂഹവുമാണെന്നും പ്രതിപക്ഷ നേതാവ് കത്തില്‍ പറയുന്നു.

I write to request your good self to kindly refrain from providing approval to the proposal of the government to appoint former Kerala High Court Chief Justice S Manikumar as the Chairperson of the State Human Rights Commission.
As a member of the selection committee of the State Human Rights Commission (SHRC), I have expressed my strong dissent in appointing the retired Chief Justice as the Chairperson .
As you are aware, the position of Chairperson of the State Human Rights Commission requires the highest level of probity and must be free of any bias towards the government in power.
However, some of Justice S. Manikumar’s decisions as Chief Justice of the Kerala High Court have raised serious concerns about his ability to function impartially and fairly, as required by the Human Rights Commission.
According to current procedure , the Chairperson of the Human Rights Commission is chosen after consulting with members of the Selection Committee, including the Leader of the Opposition.
However, in stark contrast to existing norms, only the name of former Kerala High Court Chief Justice S. Manikumar was proposed in the meeting. The details of the other eligible names in contention, as well as their eligibility, were not provided in advance. This decision to unilaterally impose one name is undemocratic and mysterious.
Furthermore, the government has implicitly revealed its intention to appoint the retired Chief Justice to the post of SHRC through unusual decisions involving him long before the selection process began.
With the state being the violator in the majority of human rights cases, I believe that the appointment of retired Justice Manikumar as Chairperson of the State Human Rights Commission will not bode well for the SHRC’s impartiality.
As a result, I respectfully request that your goodself refrain from approving the government’s proposal to appoint former Kerala High Court Chief Justice S Manikumar as Chairperson of the State Human Rights Commission.
